This waiver includes: a.) The COMPANY's employees, advisors, representatives, officers and/or shareholders; b.) Corporations related to the COMPANY; c.) The employees, advisors, representatives, officers and/or shareholders of the corporations described in this Waiver – Disclaimer; and d.) corporations in which the COMPANY'S employees, advisors, representatives, officers and/or shareholders, are in turn, employees, advisors, representatives, officers and/or shareholders.

Any claim relating to this site shall be governed by the laws of the Republic of Costa Rica without regard to its conflict of law provisions.

The Services include a technology platform that presents you with a set of one or more retailers (each a "Retailer") virtual storefronts from which you can select goods for picking and packing by one or more personal shoppers and delivery to your location. Depending on the Retailer from whom you purchase goods through the Services, picking and packing, and delivery services may be performed by third parties, which may include Retailer personnel, independent contractors, and third-party logistics providers (collectively, "Third Party Providers").

You acknowledge that neither Tulemar LLC nor any of our affiliate companies supervises, directs, or controls the performance or quality of products or services provided by Third Party Providers, and that Third Party Providers are not employed by Tulemar LLC.

Prices include sales tax (IVA or VAT). Payment for all orders is due upon guest arrival or delivery. Various payment methods are accepted including cash, credit cards, debit cards, and bank transfers. Prices are displayed in the currency of your choice, and any discrepancies due to currency conversion are the user's responsibility. Prices and currency conversion rates are accurate at the time of publication but may change in the interim between the order date and the delivery date. Prices and currency conversion rates can change at any time. The final cost is calculated at the time of delivery and is determined by providers.

You may cancel your order up to 24 hours before your scheduled arrival. Once fulfillment has begun, the order cannot be canceled. If you cancel after fulfillment has started, you will be charged the full amount. Due to the personalized nature of the service, Tulemar LLC is unable to offer refunds or accept returns.

When you use the Services to place an order for goods or services, you authorize the purchase of those goods from the Retailers, and if you have selected delivery services, the delivery of those goods by Third Party Providers. Unless otherwise specified, you acknowledge and agree that the Retailer and the Third Party Provider are collectively acting as your agents in the ordering, picking, packing, and/or delivery of goods purchased by you and that the Retailer, not the Third Party Provider, and not Tulemar LLC, is the seller of the goods to you. You agree that your purchase is being made from the Retailer, that Retailer is the merchant of record, and that title to any goods passes to you when they are purchased at the applicable Retailer's store. You agree that you are responsible for payment to the Retailer to cover the cost of the goods you have purchased from the Retailer and any additional fees, taxes, and/or optional tips.

The Retailer may change the fees it charges for goods and or services, including but not limited to delivery fees, priority fees, service fees (including additional service fees and/or surcharges to help offset specific costs), direct-to-consumer shipping fees, regulatory-related fees, bag fees, and special handling fees. Fees may vary based on demand, order attributes, and/or other factors. While prices are provided on our website, if replacement items or additional items are selected due to availability, you will be charged a higher or lower amount based on the actual items at the time of the selection by the shopper. Retailers set the prices of the goods, and some Retailers may set prices for goods that differ from in-store prices, differ between storefronts, or differ from the prices available on other online platforms or services.

You also acknowledge and agree that Tulemar LLC does not form any employment or agency relationship with you and does not hold title to any goods that you order through the Services.

Unless otherwise indicated, all prices and other amounts are in US Dollars. You may be able to select a different currency for information purposes only; however, products are sold in the local currency of Costa Rica colones.

Occasionally there may be information on this site that contains typographical errors, inaccuracies, or omissions that may relate to pricing, product descriptions, promotional offers, and product availability. Tulemar LLC reserves the right to correct any errors, inaccuracies, or omissions and to change or update information or refuse or cancel orders if any information is inaccurate at any time without prior notice (including after you have submitted your order).
